These Terms & Conditions ("Terms") govern your use of this website and any funnel review, consultation or service provided by Scale Annuities LLC ("Scale Annuities," "we," "us" or "our"). By using this website, booking a call or engaging our services, you agree to these Terms. If you do not agree, please do not use the website.

1. Who These Terms Are For

Our website and services are intended for independent annuity, insurance and financial professionals and their businesses. You must be at least 18 years old and able to enter a binding contract to use them. If you use our services on behalf of a business, you confirm you are authorized to bind that business.

2. Our Services

Scale Annuities provides marketing and client acquisition services, including funnel reviews, advertising, landing pages, websites, branding, follow-up systems and AI-generated likeness ("AI clone") content. The free 30-minute funnel review is a consultation only. Any paid engagement will be described in a separate written proposal or agreement, which controls if it conflicts with these Terms.

3. No Guarantee of Results

Marketing results depend on many factors outside our control, including your offer, market conditions, advertising platforms, your sales process and your follow-up. We do not guarantee any specific number of leads, appointments, cases, commissions, revenue, cost per lead or return on investment.

Results, case studies and testimonials shown on this website, including those of William Rapp and Exclusive Annuities, reflect the experience of specific clients. They are not typical, are not a promise of future results, and your results may differ. Where a client relationship exists between Scale Annuities and a person featured on this site, we disclose it.

4. Not Financial, Insurance, Tax or Legal Advice

Scale Annuities is a marketing company. We are not a broker-dealer, investment adviser, insurance agency or law firm, and nothing on this website or in our services is financial, investment, insurance, tax or legal advice. The annuity market figures we cite come from third-party sources such as LIMRA and are provided for general information only.

5. Your Responsibilities and Compliance

• You are responsible for your own licensing, product suitability, disclosures and compliance with laws and regulations that apply to you, including state insurance regulations, FINRA and SEC rules where applicable, and your carriers' and IMO's advertising approval requirements.
• You are responsible for reviewing and approving all advertising, pages and messages before they go live, and for obtaining any compliance approvals required in your business.
• You agree to follow the advertising policies of Meta, Google and any other platform where your campaigns run, including rules for financial products and services and special ad categories.
• You are responsible for how you contact leads, including obtaining any consent required under the TCPA, the CAN-SPAM Act, state telemarketing laws and do-not-call rules.

6. AI Clone and Likeness Content

We will only create AI-generated likeness content of a person who has given written consent. By providing photos, video or voice recordings, you confirm that you own them or have permission to use them, and you grant us a license to use them to create and run content for your campaigns. You may withdraw consent for future content at any time in writing. AI-generated content will be labeled or disclosed where a platform or law requires it.

7. Communications

By booking a call or submitting a form, you agree that we may contact you by email, phone and, where you have given the consent required by law, text message, about your inquiry and our services. Message frequency varies. Message and data rates may apply. Reply STOP to opt out of text messages or HELP for help. You can unsubscribe from emails at any time using the link in any email. Consent to receive marketing messages is not a condition of any purchase.

8. Fees and Payment

The funnel review is free and carries no obligation. Fees for any paid service are set out in your proposal or agreement. Unless that agreement says otherwise, fees are due as invoiced and are non-refundable once work has begun. Advertising spend paid to platforms such as Meta or Google is separate from our fees and is your responsibility.

9. Intellectual Property

This website and its content, including text, graphics, logos and design, belong to Scale Annuities or its licensors and are protected by law. You may not copy, reproduce or distribute them without our written permission. Ownership of work we create for you is set out in your service agreement.

10. Acceptable Use

You agree not to misuse this website, including by attempting to gain unauthorized access, interfering with its operation, scraping it, or using it for any unlawful, deceptive or fraudulent purpose.

11. Third-Party Services

We rely on third-party platforms such as Meta, Google, scheduling tools and CRMs. We are not responsible for their availability, policy changes, ad rejections, account restrictions or actions, and your use of them is governed by their own terms.

12. Disclaimer of Warranties

This website and our services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

13. Limitation of Liability

To the fullest extent permitted by law, Scale Annuities will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, commissions or data. Our total liability for any claim relating to the website or our services will not exceed the amount you paid us in the three months before the claim arose, or one hundred U.S. dollars if you have paid us nothing.

14. Indemnification

You agree to indemnify and hold harmless Scale Annuities and its owners, employees and contractors from claims, losses and expenses, including reasonable attorneys' fees, arising from your use of the services, your advertising content, your contact with leads, or your breach of these Terms or of any law.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction.

16. Platform Disclaimer

This site is not part of the Facebook website or Meta Platforms, Inc. Additionally, this site is not endorsed by Facebook in any way. FACEBOOK is a trademark of Meta Platforms, Inc. Google is a trademark of Google LLC, and this site is not endorsed by or affiliated with Google.

17. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above shows when they last changed. Continued use of the website after changes means you accept the updated Terms.
